
The U.S. Supreme Court is hearing arguments in a lawsuit challenging an Illinois law that governs how mailed-in absentee ballots are counted after Election Day. The case, brought on behalf of Congressman Mike Bost and two presidential electors, marks a historic test of whether they have legal standing to contest the state’s policy allowing ballots received up to 14 days after Election Day to be counted.
Justices are focusing their questioning on the issue of standing — whether the plaintiffs have the right to bring the case — rather than on the constitutionality of Illinois’ post–Election Day ballot counting itself.
